some very important info re: paid accounts~

I am not a lawyer, but I can decently interpret legalese and, being as I also suffer from tl;dr syndrome and assume others may as well, I took one for the team and went through the updated TOS for the post+ accounts and highlighted (what I understand to be) the most pertinent information, which ultimately comes down to this:

You cannot monetize copyrighted works (aka charge and earn money from fanfic, fanworks, etc) and if you do decide to put your fanworks behind a paywall via Tumblr, when you are inevitably sued, Tumblr will not protect you and will not defend you and you alone, personally, will be responsible for whatever monetary damages said lawsuit results in.

If anyone is a lawyer and knows I’ve gotten any of this wrong, please do not hesitate to correct me/this post.

1. Your paid account will not be hosted by tumblr; it is routed through a 3rd party.

2. By signing up for a paid account, you’re entering into an agreement with Stripe, so in addition to Tumblr’s TOS, you are also bound to Stripe’s TOS.

3. Stripe, like Tumblr, will not defend you or protect you against any lawsuits.

4. Furthermore, you may end up owing Stripe money (indemnify = compensate)

5. Tumblr’s TOS specifically states that you can’t put any content on your post+ account that violates any laws, including laws that protect intellectual property rights of others. This is super important, because Tumblr’s post+ FAQ also states that you can post anything that you would regularly post on tumblr, which I’m sure many will take to mean that gifsets, fanworks, etc are fair game, since all of that stuff can be posted on tumblr now. However, the difference is, you’re not making money from the fanworks you’re posting or reblogging now. Once money enters the equation, the game changes.

Tumblr is making it seem like any and all content goes for post+ accounts, knowing 90% of this site is fanworks. This is not true and you’ll be opening yourself up for lawsuits if you charge for fanworks.

6. Tumblr further disclaims any and all liability in any legal issues.

tl;dr: Please do not make a post+ account, bc you will be opening yourself to lawsuits and if that happens, Tumblr’s response will be not our problem, you agreed to all the terms which said you couldn’t do that, sorry not sorry. Please protect yourself.

synopsis: when mingi, a cashier at a convenience store, always notices the same person buying banana milk at 1am

the convenience store door chimes as you enter. a noise you've grown accustomed to for coming here almost every night

your entrance makes the worker poke his head up. because it's late and most workers would be thinking 'who would be coming to the store at this time?'

but not this worker. he's here every time you come in, he watches as you pick up the same item each night and bring it to him to ring up for it

he's here every night just like you but for entirely different reasons. he's forced to be here working these tiring hours just wishing he could go home and sleep while you're here here, seemingly full of energy with no ounce of tiredness being shown always getting the same item

although you two see each other every night, even if briefly, he's never made effort to start or hold a conversation. the only passing words being the basic "is this all?" and your quiet "thank you". however some nights you do find yourself intrigued by the mysterious man. some nights you do want to talk to the unknown, and well, handsome man. but that conversation never comes

until tonight of course

after grabbing your singular milk that you came here for, you make your way to the register, to the familiar, yet unfamiliar face

and when he speaks a real sentence, not in his faint customer service voice anymore, you definitely weren't expecting his voice to be that deep. as if he wasn't attractive enough to you

"banana milk again tonight i see," he muses. it's pretty a basic conversation starter, but finally one nonetheless

"you know me so well don't you?" you jokingly reply. he just smiles at you and continues ringing your item up

"i know you well enough to know that i don't even need to tell you the total and you'll still hand me the exact amount, right?"

and he's right, you hold out your hand with exact amount of money needed, "$1.27 exactly, not a cent less or more, but you know that," you say

except this time when you go to hand him the money, he stops you, "no need, tonight it's on me," you smile it's not what you were expecting at all but who are you to pass up free stuff? especially from him

"don't even know my name and you're already buying me stuff," you joke again

"mingi," is all he replies with a small smile

"what?"

"my name, it's mingi," and finally you put a name to the face

"y/n"

"pretty," he compliments. it's a simple, normal compliment from someone you barely know but yet it still has your face feeling warm

as he hands you back your item he continues again, "how about i grab a banana milk myself and we drink them together? i got all the time in the world"

"i'd like that," you say while smiling up at him
