Help Stop the Unconstitutional Execution of Freddie Owens in South Carolina on September 20 (this Friday)

Freddie Owens, also known as Khalil, is scheduled to be executed in South Carolina on Friday 20 September for the tragic murder of Irene Graves during an armed robbery. He did not have a fair trial and he has brain damage (from injuries from a traumatic childhood of abuse), meaning executing him would violate the Eighth Amendment.

Background of the case/why the trial was unfair: Freddie Owens is due to be executed on September 20 for the tragic murder of Ms. Irene Graves during an armed robbery. Owens’ attorneys require more time due to new evidence that has come to light which puts his conviction into doubt. The only other eyewitness to the robbery was Owens’ accomplice, Steven Golden, who was offered a plea deal if he testified against Owens. The only evidence that it was Owens who shot Ms. Graves is Owens’ testimony—there is no forensic evidence to confirm he was the shooter. During Owens’ original trial, Golden (who had already pleaded guilty) stated that neither the death penalty nor a life without parole sentence had been taken off the table for him. However, in a recent motion Golden has stated that the prosecutor told him to say this, and in fact his plea deal would allow him to avoid both of those sentences—he is scheduled for release in 2026. During the trial the judge told jurors that Golden’s testimony was credible because he had nothing to gain from testifying against Owens—we know now that this is not the case. The fact that information regarding Golden’s plea deal and the credibility of his testimony was withheld from Owens’ lawyers and that the jury was misled in this way puts the entire basis on which Owens’ conviction rests into doubt.

Furthermore, Owens was fitted with a stun belt (a device that can allow law enforcement to deliver an electric shock) during his original trial. Many states believe that using stun belts during trials is the equivalent of having the prisoner in shackles and therefore question their suitability for use in a fair trial (as they create a presumption of guilt). Nonetheless, in Owens' trial it was visible, with one juror commenting on it and saying she knew what it was for.

I will add that he is due to be executed by lethal injection using a new procedure, and his attorney "is still unsure prison officials have released enough information about the drug to assure it will kill him without causing unbearable pain or agony that could be cruel and unusual punishment" (from AP News).

The only person with the power to save Owens' life now is Governor Henry McMaster, who "has said he will follow longtime tradition and not announce his decision [to grant clemency or not] until prison officials make a call from the death chamber minutes before the execution" (from AP News).

Please contact South Carolina Governor Henry McMaster and tell him that commutation to life without parole is an appropriate punishment and executing Freddie Owens would be unconstitutional!
