I have two theories. The "birthdays" are just something Peter gives Jake so that he can be happier (If Jake grew up without them like Hook did), or you might just willing to bet that Peter's just biased at this point.
1. He doesn't kill Jake for being a pirate even though he supposedly hates them.
2. He lets Jake grow up instead of dropping him into the real world for him to become an adult. (Like with the Lost Boys)
3. The birthdays don't specifically say how old he is. Sure, we can guess that he was originally 8 years old and he's had 2 birthdays so he's 10 by Season 4, but that's practically the only thing that we can speculate.
