WHAT IS THE EARN IT ACT?
The EARN IT Act has been roundly condemned by nearly every major LGBTQ+ advocacy and human rights organization in the country. This is a bill that will make children less safe, undermine online safety and security, and trample free expression, because it carves out another exception to Section 230 of the Communications Decency Act (CDA 230), which the ACLU describes as âfoundational to modern online communications.â This has been the law that has let the internet grow into what it is today, weâve had this law since the 90s. (For context, Trump wanted to get rid of this law because he knew it would lead to mass govt surveillance and censorship of minorities online.)
The EARN IT Act will lead to online censorship. Platforms will be incentivized to scan their usersâ communications and censor all sex-related content, including sex education, literally anything lgbt, transgender or non-binary education and support systems, and sex worker communication according to the ACLU. All this in the name of âprotecting kidsâ and âfighting CSEMâ, both of which the bill does nothing of the sort. In fact it makes fighting CSEM even harder.
If this bill passes, we're going to see most, if not all, adult content and accounts removed from mainstream platforms, for fear of the liability that could come with ever accidentally hosting CSAM, as well as the erasure of end-to-end encryption on messaging platforms.
This is really not a drill. Anyone who makes or consume anything âadultâ online has to be prepared to fight Sen. Blumenthal's EARN IT Act, brought back from the grave by a bipartisan consensus to destroy Section 230.
EARN IT will open the way for politicians to define the category of âpornography" as they â or the lobbies that fund them â please, (Right now, right wing organizers are catgorizing books about racism as âpornâ to ban them from schools) which is a cherished goal of organizations that seek to reintroduce obscenity prosecutions for content now protected by Free Speech jurisprudence. This will 1000000% be used to eradicate anything LGBT online.
What this bill says it does on the surface is make platforms liable for their usersâ activity if that activity involves sex and minors. However, because of 230, platforms are not liable at all about their users' activity. This has allowed platforms to grow and thrive and many niches online to as well. The bill also creates an unelected commission to create âbest practicesâ to combat online child sexual exploitation. While these recommendations are nominally voluntary (so Americans have no decision on who gets to be on it), platforms that refuse to comply will be liable for criminal prosecutions and lawsuits should the government decide any of their users is engaging in online child sexual exploitation.
This is already a nightmare enough. But the bill also DESTROYS ENCRYPTION, you know, the thing protecting literally anyone or any govt entity from going into your private messages and emails and anything on your devices and spying on you.
This bill is going to finish what FOSTA/SESTA started. And that should terrify you.
Senator Blumenthal (Same guy who said âFacebook should ban finstaâ) pushed this bill all of 2020, literally every activist (There were more than half a million signatures on this site opposing this act!) pushed hard to stop this bill. Now he brings it back, doesnât show the text of the bill until hours later, and itâs WORSE. Instead of fixing literally anything in the bill that might actually protect kids online, Bluemnthal is hoping to fast track this and shove it through, hoping to get little media attention other than propaganda of "protecting kids" to support this shitty legislation that will harm kids.
The entire EARN IT act is based on *multiple* misunderstandings of the law and reality. It's a really really really bad policy that will do serious harm. But because Senator Blumenthal wants headlines, he'll pretend that it "helps protect the children." It won't. It'll do real damage. It will make CSEM much much worse.
One of the many reasons this bill is so dangerous: It totally misunderstands how Section 230 works, and in doing so (as with FOSTA) it is likely to make the very real problem of CSAM worse, not better. Section 230 gives companies the flexibility to try different approaches to dealing with various content moderation challenges. It allows for greater and greater experimentation and adjustments as they learn what works -- without fear of liability for any "failure." Removing Section 230 protections does the opposite. It says if you do anything, you may face crippling legal liability. This actually makes companies less willing to do anything that involves trying to seek out, take down, and report CSAM because of the greatly increased liability that comes with admitting that there is CSAM on your platform to search for and deal with. This liability would allow anyone for any reason to sue any platform they want, suing smaller ones out of existence. Look at what is happening right now with book bans across the nation with far right groups. This is going to happen to the internet if this bill passes.
(Remember, the state department released a report in December 2021 recommending that the government crack down on "obscenity" as hard the Reagan Administration did. If this bill passes, it could easily go way beyond shit red states are currently trying. It is a goldmine for the fascist right that is currently in the middle of banning every book that talks about race and sexuality across the US.)
NCOSE, the far right anti-LGBT hate group behind the global anti-sex legislations, is pushing the idea that any form of sexual expression, including talking about HEALTH, leads to sex trafficking. Their goal is to eliminate all sex, anything gay, and everything that goes against their idea of âGodâ from the internet and hyper disney-fy and sanitize it. This is a highly coordinated attack on multiple fronts.
The reason these bills keep showing up is because there is this false lie spread by organizations like NCOSE that platforms do nothing about CSEM online. However, platforms are already liable for child sexual exploitation under federal law. Tech companies sent more than 45 million+ instances of CSAM to the DOJ in 2019 alone, most of which they declined to investigate. This shows that platforms are actually doing everything in their power already to stop CSEM by following already existing laws. The Earn It Act includes zero resources for proven investigation or prevention programs. If Senator Bluementhal actually cared about protecting youth, why wouldnât he include anything to actually protect them in his shitty horrible bill?
The Center for Democracy & Technology (CDT) along with a coalition of 26 civil society organizations urged the United States Senate to reject the EARN IT Act. Groups on the left and right, including the ACLU, Fight for the Future, EFF, and Hacking // Hustling oppose it. Because it threatens free expression online and will threaten marginalized peopleâs safety while being totally unnecessary and failing to fix the problem it claims to address. The EARN IT Act empowers states to give law enforcement access to usersâ private conversations and force companies to create encryption backdoors for law enforcement. This is totally unnecessary. Platforms are already handing over CSAM to the federal government. Itâs actually likely to make prosecuting child molesters more difficult since evidence collected this way likely violates the Fourth Amendment and would be inadmissible in court.
I don't know why so many Senators are eager to cosponsor the "make child pornography worse" bill, but here we are.
WHAT YOU CAN DO:
EARN IT Act was introduced yesterday! And itâs already scheduled to get marked up, which is the first step post-introduction. Most bills never go to markup, so this means they are putting pressure to move this through. IF YOU LIVE IN THESE STATES (IL, VT, CA, RI, MN, DE, CT, HI, NJ, and GA), CONTACT YOUR SENATOR AND HOUSE MEMBERS NOW. THIS IS URGENT. This is who gets first crack, and folks in all have Senators who are on the Judiciary committee.
I'm guessing this month or March is when the bill would be passed if there is no opposition đ The bill was re-introduced yesterday, already set for markup this Thursday. This feels like an attempt to fast track it this month. Additionally the current makeup of Congress favors those who want it passed. Back in 2020 it was mostly Senate republicans and democrats who are basically republicans (just like now, check the sponsors) pushing it with Ron Wyden using the filibuster to stop their efforts. The house dems didn't want to give Trump a win and needed to appear as pro-privacy/free speech for the 2020 election. Now the dems have the presidency, both chambers of Congress and if you've noticed have spent a few years repeatedly demanding social media censorship and desperately want to give Biden victories. biden isn't like obama who opposed sopa/pipa to appeal to younger voters. This is similar to how FOSTA passed with the group who made it happen last time back again. Far as I'm aware Wyden hasn't spoken about new earn it yet but even if he does oppose it, it's very possible there will be enough Senate democrats to join the republicans in passing it beating a filibuster. Then pelosi's band of house idiots pass it and we have to choose between breaking the law because they can't stop us from using encryption or being obedient sheep to a group who consider themselves above laws.
It already has a fifth of the Senate cosponsoring it. There is a very very very real chance this bill becomes law. This is an uphill battle that's going to happen fast and quick. PLEASE, FIGHT NOW.

it's ridiculous how so many usamericans, especially social democrats, hold up fdr and the new deal as the best time in usamerican society. the new deal was granted to workers only as a concession during the great depression to prevent the growing communist movement from taking hold and overthrowing capitalist rule. the communists at the time warned that if the bourgeoisie could give the proletariat these rights, then they could also take them away. and they were exactly right. the prosperity that (white) usamericans enjoyed from the 1940s onward, which has only been sustained for so long by the usa's subjugation and exploitation of both its own minorities and the global south, was piece by piece stripped away, until we got to where we are now. so when people like bernie sanders and aoc call for social democratic reforms, just remember that the purpose of these reforms is to extend the lifespan of capitalism, and that if enacted, they too would be stripped away until we're right back here again. the only path forward is communism.
Every successful revolutionary movement must posses in its vanguard not only a fighting army, but also an army of labour.
The fighting army is an armed body of the vanguard party, tasked with carrying out political work. The army of labour consists of the class-conscious, active revolutionaries engaged not in warfighting, but production. During higher stages of revolution, this may entail running wartime industry and infrastructure, but in early stages has much more in common and with unionisation tactics, and is done in connection with labour unions themselves.
Further, all revolutionary fighting armies must also be, in some part, productive armies, armies of labour (so as to maintain themselves, build up their own base areas and infrastructure, etc). While revolutionary movements possessing only armies of labour (in the case of more backwards organisations), is common; the counterpart, of supposed revolutionary movements with a dedicated political corps but absolutely zero connection to the masses (and therby no army of labour), is tending to become equally as common.
The immediate task of the proletarian vanguard, in such a deteriorated political environment, is not just training with guns or spending the weekend "innawoods". It is, principally, building up the ranks of the army of labour to such a degree that they can politically support a fighting army when the time for one comes about.
This is the one of the final opportunities Biden and Harris had to prove that they care about regular people before the elections and they fucking fumbled it. since january the white house has rebranded a "humanitarian pause" as a ceasefire
joe biden has called for "a ceasefire" since february
in may joe biden said rafah was a red line and the US would not support the invasion of rafah (rafah has since been invaded and destroyed, after which netanyahu was invited to congress)
in early may the white house proposed a three-step plan to an actual ceasefire, which israel rejected and then killed the hamas leader they were negotiating with
the white house has not been forthcoming about israel being the one rejecting the ceasefire, nor israel's escalation within the region

literally untrue: the US paused ONE shipment of 2,000 pound bombs and some 500 pound bombs in may after denouncing a potential rafah invasion, then resumed the 500 pound bombs in july after the invasion occurred with multiple massacres
a 3.5 billion military aid package was sent on august 9th, 2024, to be spent on pretty much whatever israel wants
previously imposed symbolic "sanctions" on only one unit of the IDF accused of crimes against humanity was overturned
imposed "sanctions" on 7 (seven!) extremist settlers were clarified to make sure they still had access to their assets
the biden admin opposed ICC warrants on israel as early as 2021, leading to consistent delays in the ICC doing its job, and rejected the announcement for warrants in 2024, which have still not been actually sought due to the US continuing to exert pressure against the ICC
the white house also criticized the advisory finding from the international court of justice that israel is an apartheid state
the white house has vetoed multiple security council resolutions calling for a ceasefire in gaza
the white house vetoed resolutions calling for the admission of palestine as a member state
the white house also called the case for genocide at the ICJ "unfounded" although the ICJ did find sufficient evidence for genocide and had imposed provisionary measures (which israel did not fulfill)
the white house has reaffirmed full backing for israel "against iran" even after its escalatory assassinations of both lebanese and palestinian political leaders, and deployed more troops, aircraft carriers, and missile cruisers to the middle east in august
therefore, while the biden admin acknowledges that israel stands in the way of a ceasefire, they are not pressuring israel to stop and instead providing both diplomatic immunity and military support to its escalatory actions in the region

how much does israel actually rely on US weaponry? that's impossible to tell, but national security correspondent greg myre told NPR:

Tanks are actually made in Israel but with an American engine, and aircraft are American. These are American-made systems. [...] So Israel has its own advanced military technology. But when it comes to the hardware - planes, artillery, guns - it does rely heavily on the U.S.
the US might not have as much influence on israel as it used to (and certainly israel would like to think so) but in the most basic compliance with international law the US can halt weapons shipments and recognize the jurisdiction of the ICC and ICJ, ending the diplomatic immunity it affords israel in the international arena to continue its genocide of gaza.
the UK is hardly much better, but it has withdrawn its intention to block the ICC warrants for israeli leaders and it has resumed funding the UNRWA, two low bar concessions that the US has refused.
these are regular political maneuvers. your civil rights should not be held hostage so the US can protect israel. it makes no sense for democrats to frame it that way while also claiming to want a ceasefire.
if kamala wants a ceasefire, why isn't she agreeing with the pro-palestine movement? their demands are all things that are in-line with wanting a ceasefire. an arms embargo is the natural step to a ceasefire, because you cannot say you want a ceasefire and then send 3.5 billion in military aid to the people who assassinated the negotiators for a ceasefire.
if kamala wants a ceasefire, and you want to vote for kamala, then you should encourage her to take the steps towards a ceasefire. otherwise you are running cover for genocide, just as biden's admin has been doing. your civil rights are not based on continued support for palestinian genocide, and they shouldn't be. to pretend otherwise is a betrayal of all the civil rights activists in the US, who knew that US foreign policy, from the war in vietnam to the iraq war, were unjust imperial wars, and they opposed them unconditionally, regardless of who was perpetrating this war.

Since folks are exhausted from hearing about Project 2025 and Agenda 47, here are some reasons to feel hopeful about Harris

Project 2025 would ban anything the far right considers pornography. The far right considers anything queer-positive to be pornography, and they WILL encode that into law if given just a TINY bit more power.
Have queer fanfic (or trad published literature) or pics of your transition, or of two men kissing, saved to your hard drive? If the GOP get their way, you'd be guilty of possession of pornography. Did you share any of it? You'd be guilty of distribution of pornography. Have a sweet coming of age story with a queer protagonist? That'd be child pornography.
Even now, states are trying to make it a crime to be openly queer in public (by, among other things, classifying dressing as the "wrong gender" anyplace kids might see as a sex crime against children). Oh, and Florida tried (and thankfully failed) to impose the death penalty for the above.
This is just one example of the horrors awaiting us if the project comes to fruition.
And the far right is already screaming that any adult who mentions around kids that queer people exist is "grooming" children. Wear your Pride shirt past a playground? You're now a child groomer. Think they won't put that into law if allowed? You're naive.
The GOP currently controls the Supreme Court (which is how they overturned Roe v. Wade) and has a majority in one branch of congress. Imagine what will happen nationwide with the GOP controlling every branch of government, including supermajoroties in both houses of Congress.
Oh, and top GOP officials have also announced their desire to NUKE Gaza, so don't come at me with, "but I can't vote blue because Biden..." Or tell me how you think Gaza would somehow be better off with Trump and the GOP.
In France, the left and center joined together--even though they disagree vehemently on many issues (get two leftists together and they'll have three positions on any issue)--to stop the far right from totally taking over, because the one thing they ALL agree on is that fascists dictatorships are BAD.

"Every election, they tell us this is the most important election if our lives!" Yeah, because each election over the past several decades has been more important than the one before, until we are now at a tipping point between remaining a fucked up oligarchy with SOME resemblance to freedom, and an outright neo-fascist military dictatorship.
Trump has literally stated publicly his intent to criminalize dissent, use US armed forces against protesters (Kent State, but multiply it by thousands), purge all agencies and stuff them with those personally loyal to him, and use the DOJ to go after anyone he perceives as a threat to his political power, among other things.
And remember the things he did in office, like pulling the teeth of federal workplace protections for queer folks (which Biden reatored).
I don't care if you don't like Biden or Harris. Neither do I. But the alternative is Trump, and anyone telling you not to vote in 2024, or to vote third party, is rooting for Trump, and for Project 2025. Anyone telling you not to vote does not give one single solitary flying fuck about vulnerable populations in the US or anywhere else in the world.

Here are some options y'all seem to insist on and why they're fucking stupid:
Vote Third Party :: Until we have ranked-choice voting (and probably even if we did have ranked-choice voting), it is practically impossible to make a 3rd-party candidate viable. There's not enough of the population that's far enough from moderate to give up their "safe" blue vote for some "revolutionary."
Don't Vote At All :: I'd prefer to pick my enemy. If I'm going to be working in spite of the government, or even against it in some ways, I'd rather the people I'm working against not already be targeting me for being queer, for example. If my options are "bad" or "much, much worse" I'm gonna pick "bad" and try to improve things from there.
Violent Revolution :: It's a cosplay power fantasy in the same vein as the Right-wingers looking for a reason to shoot protesters. Assuming you even have enough people organized and enough firepower to pull that off in the first placeâŚhave you prepared a plan to keep the innocents alive and safe? Are you sure you can keep supply chains for food and medicines intact? Are you sure there will be resources available for the disabled, the scared, the young and old, those who won't be able to fight and still need to be taken care of? Turns out revolution is ugly and causes a lot of undue collateral damage. Are the lives "saved" really going to outweigh those whose lives will be upended and destroyed? It's not like a newly-toppled, unorganized country will be able to do anything about Israel/Gaza, so you're just hurting and killing far more people than you're saving.
As for the power you do have to better things (and make Leftism more viable as a political stance in the US)?
Work at the level of your local government. If you're in a small enough town or neighborhood and think you have what it takes, run for local office. Be a local face of the left wing; you're far more likely to sway a small town to your views than the whole country, and each small town with a socialist-leaning government is a dot on the map for larger-scale viability, and you can help keep your community safe while trying to build up in scale.
Build community so we can keep each other safe if worse does come to worst. Push mutual aid initiatives, help at food banks, grow produce to donate to those in need, apply to work at your local free clinic, empower local businesses whenever possible so that if there is a socioeconomic collapse, you and those you love aren't left completely without resources.
Protest, and make it disruptive. You can be disruptive without being violent: graffiti, blocking roads, encampments, sit-ins, to name a few examples. Create inconveniences so it gets people's attention whether they like it or not.
Above all, FUCKING VOTE BLUE. You're choosing your enemy. You get to help decide if the government we're working in spite of is run by milquetoast neoliberal war hawks who do, on some rare occasions, actually make things marginally betterâŚor full-tilt Christo-fascists who want to kill some of us for kissing people with the same genitals as us. There aren't any other options that are going to be picked. It sucks, but at the bare minimum we can pick the option that isn't going to actively murder us while we try to build up viability for a candidate who won't sell out brown people to an ethnostate.
If you aren't doing at least one of the things above, then don't lecture me about how I keep myself and my community safe. I'd love to see a United States (or some future iteration of it) that acknowledges the sovereign rights of indigenous peoples, that doesn't fund genocide, that provides healthcare as a basic human right, that doesn't meddle in every other country's business. But if we are to see that, let alone help that happen, we need to survive this next presidential administration.
